HOW TO CHECK DESIGN PATENT APPLICATION STATUS

STEP 1: To access the main site of Intellectual Property i.e. http://www.ipindia.nic.in/  and click on the E-

STEP 2: Once you click on the E-Gateways option a page will open which shows the various services provided by the Intellectual property India like- E filing, Public search, status etc.

STEP 3:
Once the other page opens for checking the status of your application you are required to click on the Design in the Status column.
To access directly to the design status i.e., https://search.ipindia.gov.in/DesignApplicationStatus

STEP 4: Once the option is clicked it will open a new page / window, where you are required to enter the application number in the field titled “Application Number” and write captcha code in the respective field and click on “Show Status”.

(-001) is compulsory for checking status – with no space

STEP 5: Clicking on the show status at the end of the page will take you to a page displaying the application number, CBR number, applicant name and status.

What are the various stages and the timelines involved in the grant of an Indian design application?

After filing a design application in India, there are several steps that typically follow in the registration process. Here is a step-by-step guide on what to expect next:

  1. Filing Acknowledgment:

Upon submitting your design application, you should receive an CBR receipt from the Indian Patent Office. This CBR receipt typically includes the filing date and application number.

  • Formal Examination:

The Design Office will conduct a formal examination to ensure that the application meets the necessary requirements. This includes checking for completeness, proper classification, and adherence to formalities.

  • Examination Report:

If any objections or issues are identified during the examination, the Design Office will issue an Examination Report. This report will outline the objections raised and provide an opportunity for the applicant to respond.

  • Response to Examination Report:

The applicant needs to respond to the Examination Report within the stipulated time frame, usually within six months. The response should address and overcome any objections raised by the Design Office.

  • Publication:

If the application passes the formal examination, it will be published in the Design Office Journal. The publication usually occurs within a few weeks of the formal examination.

  • Acceptance or Rejection:

Based on the applicant’s response, the Design Office will either accept the design for registration or reject it. If accepted, the design will proceed to registration.

  • Registration and Certificate:

Upon acceptance, the design will be registered, and a certificate of registration will be issued. The certificate is a crucial document confirming the exclusive rights to the design.

  • Renewal:

Design registrations in India are valid for ten years from the filing date. After the initial registration, it is essential to renew the design registration periodically to maintain protection.

STAGES OF DESIGN APPLICATION STATUS:

  1. Application Under Process (wating for Technical Examination)

The design application is currently under review, awaiting technical examination to ensure compliance with filing requirements and design regulations.

2. Examination Report has been Generated, Online Reply Document Received (FER generated on 26/06/2023)

A First Examination Report (FER) is generally issued within 1-2 months from the date of filing of the application in India. Reply to FER must be filed within six months from the date of filing.

  • Case is in Amended Case of Controller

The design application is currently in the amended case stage, indicating that the applicant may have made necessary modifications or clarifications as per the feedback received from the Controller. It is expected to take a few weeks to be granted after reaching this status in the portal.

  • Application Accepted, Certificate of Design not Generated.

The design application has been accepted, indicating that it meets the necessary criteria. However, the issuance of the Certificate of Design is pending and has not yet been generated. It is expected to take up to 2 weeks for it to be granted after this status is shown in the portal.

  • Application Accepted, Certificate of Design Generated.

The design application has been accepted, and the Certificate of Design has been successfully generated, indicating the formal recognition of the registered design. It is expected to take up to 1 weeks for it to be granted after this status is shown in the portal.

  • Design Accepted and Published, Journal No is xxx and Journal Date is xxxx

The design has been accepted, published, and assigned a Journal Number with a Journal Date. This typically occurs after the acceptance stage and publication usually takes place within 2-4 months from filing and If FER raised then it takes 4 to 6 months
